If you have been convicted of an offence and sent to prison for more than 12 months then you will be subject to automatic deportation. There are however exceptions and we would strongly advise you seeking our professional advice in this area.

At J M Wilson Solicitors we recently defeated the Home Office in the Supreme Court by successfully challenging their rule in this area known as the ‘deport first and appeal later’ scheme.

The Supreme Court Judges agreed with our submissions that the Home Office decision to deport foreign criminals before their appeals had been heard, was in fact unlawful. We were able to stop this practice from continuing. Read more on this case here
